Prenuptial Agreements

A prenuptial agreement is a very sensitive and complex undertaking which requires great forethought and analysis. Zoller|Biacsi regularly drafts agreements wherein the disposition of the clients assets upon death or divorce is determined. We have prepared prenuptial agreements which have withstood challenge in both the domestic and probate arenas.


Dissolution

A dissolution is a divorce, by agreement, wherein the parties decide to terminate their marriage. The terms and conditions of dissolution of a marriage is outlined in an agreement that is prepared and executed prior to any pleading being filed with the Court. Zoller|Biacsi concentrates in this area of law and has represented several thousand clients in negotiating resolutions to their individual families, situations and needs.

Divorce

A divorce is the termination of a marriage wherein one party files a Complaint for Divorce against the other and the issues are presented to the Court. Often times, the issues that present themselves to our clients are argued before the Court and ultimately resolved. If a matter cannot be resolved the case is tried before a Judge or Magistrate. Zoller|Biacsi has a positive presence and reputation at the Domestic Relations Court.

Spousal/Child Support

Zoller|Biacsi is capable of computing a sophisticated array of spousal and child support scenarios. There are many factors taken into consideration when computing support calculations. The issues revolving around spousal support entail delving into tax considerations, the needs of the spouse entitled to support and the standard of living that the parties have enjoyed. Child support is determined by a formula using the income of the parents, the costs of health insurance and day care. Spousal and child support is paid based on the payor's pay cycle. Payments are generally made via a wage garnishment and may be paid in the form of a check or a direct deposit. The funds flow through the Child Support Enforcement Agency to the payee spouse.

Custody & Allocation of Parental Rights and Responsibilities

Zoller|Biacsi is versed in the area of the allocation of parental rights and responsibilities. This area of litigation is handled in a manner most appropriate to each individual situation. There are instances where the Court may appoint a Guardian Ad Litem, an attorney, who represents the best interests of the minor children. Expert testimony may be presented to the Court by way of engaging the services of a psychologist.

Juvenile Matters

Zoller|Biacsi handles matters that include issues revolving around children born out of wedlock. Custody matters that are in the Juvenile Court are frequently more complex than cases in Domestic Relations Court. Zoller|Biacsi practices on a regular basis in the Juvenile Court and advise our clients in matters concerning custody, abuse, dependency and neglect cases.

Post Decree Enforcement

Zoller|Biacsi is skilled in handling matters that frequently present themselves after a couple has divorced. Often times, circumstances present themselves in families wherein change is necessary, inevitable and in the best interest of the minor children. The enforcement of a court order is the goal in post decree matters.
